Attorneys for the Thomas Moore Society, which is fighting the lawsuit filed by 25 same-sex couples seeking the right to marry in Illinois, are appealing a judge's decision to allow parts of the case to move forward.
Late last month, Cook County Circuit Court Judge Sophia Hall allowed two of five arguments in the lawsuit filed by ACLU Illinois and Lamba Legal on behalf of the couples in the lawsuit to proceed; namely that the ban on same-sex marriage violates the state constitution's equal protection clause and that it violates the due process rights of gays and lesbians.
According to the AP, arguments for the motion to appeal will be heard next month on November 14. Meanwhile, the plaintiffs are looking for a quick summary judgement in their favor, but no date has been set for oral arguments on that request.
